Terms of use
Terms of use
[!NOTE] Summary, in plain words
- Use the software and products you buy here lawfully and responsibly, and never in a way that causes, or could be seen to cause, harm to others.
- Your license is for you (or your organization) only, within the plan, seats and term you bought. Don't share, resell or hand out your license keys or your account.
- Whether the software fits your needs is up to you. It's provided "as is", and we aren't liable if it doesn't work, or doesn't work the way you hoped.
- Subscriptions renew until you cancel. Cancelling stops future charges from the end of the current period.
- Be respectful with our support staff. Reviews and other submissions are moderated (including automatically, with AI) and may be declined if they're harmful or disrespectful.
- If you break these terms, or abuse the service, other members or our software, we can suspend your account and suspend or revoke your license.
1. About these terms
These terms of use ("terms") are an agreement between you and Sonam's Esthetic Touch ("we", "us", "our"). They cover the Sonam's Esthetic Touch store at https://store.sonamesthetictouch.com/, your account, and the software, licenses, subscriptions and services you buy or use through it (together, "the software").
By creating an account, making a purchase or using the software, you accept these terms. If you accept them on behalf of an organization, you confirm that you're allowed to, and "you" then means that organization.
If we also ask you to accept an end-user license agreement (EULA) in the customer portal, it applies as well. Where the two disagree about the software itself, the EULA wins.
Our privacy policy explains how we handle personal information, and our refund policy explains how refunds work. Both are part of these terms.
2. Your account
- You can create an account with the store itself, with your email address and a password.
- Keep your sign-in details safe: you're responsible for what happens under your account.
- Keep your information accurate, especially your email address, so we can reach you about your purchases.
- When you act for an organization (you've chosen it as your active organization), purchases and licenses belong to that organization, and its administrators can see and manage them.
3. Your license
When you pay for a product, we grant you a non-exclusive, non-transferable license to install and use it only within what you bought: the plan, the number of seats, devices or concurrent users, and the term shown on your order and license. Everything not expressly granted stays with us or our licensors. Buying a license doesn't transfer ownership of the software.
No sharing
You may not share, publish, sell, resell, rent, lend, sublicense or otherwise distribute license keys, license files or tokens, or access to your account, to anyone outside the scope of your license. An organization's license may be used by the members it assigns, within its seats.
The software checks its license with our servers. We use those checks to enforce seat limits and to detect sharing (for example, one license used on many unrelated devices or networks). Don't tamper with, work around or disable license checks, seat limits or activation.
Personal and non-commercial plans
Some plans are for personal, non-commercial use only. They're bought from your personal account, and you confirm the personal use when you buy (we keep a record of that confirmation). Using a personal plan for an organization or for commercial work isn't allowed.
Organization size
Some prices and plans depend on the size of your organization. When we ask, give a truthful size; we keep a record of each declaration. If your organization grows beyond the size you declared, choose the right plan or size when you next buy or renew. We may ask you to move to the right plan.
4. Acceptable use
You agree to:
- use the software in a legal and responsible manner, and follow the laws that apply to you, including export and sanctions laws;
- not use the software in any way that causes, or may cause or be perceived to cause, harm to others: people, organizations, their systems or their data;
- not use the software or the store to break the law, infringe anyone's rights, spread malware, or gain unauthorized access to any system;
- not disrupt, overload or attack the store or its services, or get around rate limits, bot checks or other protections.
5. Respectful conduct and what you submit
- Be respectful with our support staff. Treat the people who help you with courtesy. We may limit or end support for anyone who is abusive, threatening or harassing.
- Submissions are moderated. Reviews, support requests, messages and anything else you write or upload in the store may be checked by automated moderation, including AI, and by our staff.
- At our discretion, we may decline, hide, edit (for example, to remove personal details such as email addresses or phone numbers) or remove a submission that contains harmful, abusive, disrespectful, hateful, misleading, spam or off-topic content, or that breaks these terms. Repeated or serious abuse may lead to losing the ability to post reviews or contact support, or to suspension of your account.
- You're responsible for what you submit. Only upload files you're allowed to share, and don't include other people's personal information.
6. Your use case is your responsibility
You decide whether the software is suitable for your purpose. Please review the product description and documentation, try the software where a trial is offered, and test it before you rely on it. You're responsible for how you use it, for the results, and for keeping backups of your data.
We do not promise that the software will meet your requirements, work with your other systems, or run without errors or interruptions.
7. No warranty
The software is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
Some places don't allow these exclusions. Where that's the case, they apply only as far as the law allows.
8. Limitation of liability
To the fullest extent the law allows:
- we are not liable for any loss that results from the software not working, or not working the way you hoped or expected;
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, even if we were told they were possible;
- our total liability for any claim about the software or these terms is limited to the amount you paid us for the software in the 12 months before the claim.
Nothing in these terms limits liability that can't be limited by law, or takes away rights you have as a consumer that can't be waived.
9. Prices, payment and taxes
Prices are shown in the store and at checkout. Payments are processed by our payment provider, Stripe; we never see or store your full card details. Where sales tax, VAT or GST applies, it's calculated from your billing address and added to the price.
10. Subscriptions, renewal and cancellation
- Subscriptions renew automatically at the end of each billing period, at your plan's price plus any tax, until you cancel. Your payment method is charged for each renewal.
- You can cancel at any time in the customer portal. Cancelling takes effect at the end of the current paid period: you keep access until then and aren't charged again.
- Changes to a subscription during a period (for example, more seats) may be charged or credited pro rata. You'll see the amount before you confirm.
- Prepaid terms are paid up front for a fixed period and do not renew automatically. Access ends when the term ends unless you renew it.
- A one-time license purchase is valid for the term shown on your order. It doesn't renew automatically unless the product says so.
- Cancelling isn't a refund. See the refund policy.
11. Suspension and revocation
We may suspend or revoke a license, subscription or account if you break these terms. For example: sharing or distributing license keys or account access, using more than you've licensed, giving a false organization size or personal-use confirmation, fraud, chargeback abuse, or harmful use.
We may also suspend access to your account (including the store, the customer portal, support and reviews) if you are, or reasonably appear to be, abusing the service, other customers or members, our staff, or our software. For example: harassing or threatening people, spamming or flooding forms, trying to get around security, licensing or usage limits, interfering with the service or other people's use of it, or using the software to harm others. The suspension can last while we look into it, and becomes permanent if the abuse is confirmed.
Where it's reasonable, we'll contact you first and give you a chance to fix the problem. We may act straight away when a breach is serious or deliberate. When we revoke access because the terms were broken, you shouldn't expect a refund (see the refund policy).
12. Changes to these terms
We may update these terms from time to time. We'll publish the new version here with a new effective date. The changes apply from that date. If you keep using the software after that, you accept the updated terms. Changes don't take back anything you've already paid for.
13. Governing law
These terms are governed by the laws of the place where Sonam's Esthetic Touch has its principal place of business, without regard to conflict-of-law rules. If you're a consumer, you keep the protection of the mandatory laws of the place where you live.
